It's considered, by the IRS, to be a pyramid structure, which is illegal.
According to that statement... every MLM business or any business that you earn money by getting others to join under you would be in the same Legal status as "cash gifting"! All MLM's are pyramid structured!

Julsy, who do you think ends up losing the money that you're making now? It's a simple enough question.

I think I have answered that question at least a few times in my previous posts. The only ones who lose are the same people that lose in ANY business they pay to get into and do nothing to build it after getting in! And I for one don't know of many businesses that only cost $25.00 out of pocket EVER! So,just like any other business, if you pay to get in and do nothing, those are the people losing the money that I am making now! But unlike most MLM's where you have to sell products or services and fail and lose money, in this business its easy to find other people willing to pay in $25.00 and are actually doing really well!

And I think that readers of this thread will form their own opinions of whether or not that's so, with no great difficulty.

I do take your point that people in many businesses can lose money if they don't do anything. The difference is that the ones you were talking about above are selling real products that real retail customers are voluntarily buying. But I do agree with you that there are some really scammy MLM programs about too, and (as any longstanding member of this forum will tell you), I do, equally, speak out against those as well (and the ones I speak out against almost invariably don't last for long, by the way: they usually disappear in a sea of legal problems after a year or sometimes even sooner). They don't make cash gifting any better, or any more legal, though.

One more question for you, if I may: why is it, do you think, that the FTC and every state's Attorney General's departments (and their equivalents in other countries) go to such lengths to warn people that cash gifting programs of exactly the type that you're promoting are illegal? The links I've provided above to prove, confirm and explain their illegality are just a few from hundreds I could have chosen you know. What do you think the reason for that is?

After all is said and done, people will still do what they want to do, it seems. The facts are very simple. Cash Gifting is an illegal activity, and if you are caught you will be prosecuted. Then again, so is selling drugs, and shop lifting, and underage drinking, etc etc...

Being illegal is not automatically a deterrent for a certain percentage of the population. So, after knowing the facts, and one still decides to take one's chances, then don't be surprised nor complain if you find Justice Department Marshals ringing your doorbell.

'nuff said

Wow! It always amazes me how someone will justify doing something illegal because "it's not huring anyone." It doesn't matter if it's $5 or if it's $50000, the fact is it's illegal, there is no product and someone, those who join a the end of the scheme will get hurt.

I wonder what Madoff thought..... I mean, he was paying out 10%, so no one was getting hurt.....

Thank Yulia for starting this.

Distessingly, there are so many of these criminal scams around at the moment, trying to prey on people's vulnerability in the current economic climate.

I hear the latest one, launching in a few days' time, is "Web Prosperity" but some of the people promoting it are already getting their websites removed by website hosts who have already learned how illegal it is, before it's even officially "trading".
